OATH ON THREE — TERMS OF SERVICE

IMPORTANT: These Terms of Service (“Terms”) govern your use of the Oath on Three website and services (collectively, the “Service”) operated by Oath on Three (“Company,” “we,” “us,” or “our”). By accessing our website or enrolling in our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

 

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, INCLUDING FINANCIAL COMMITMENTS, PRE-AUTHORIZED CONSEQUENCES, AND LIMITATIONS ON REFUNDS.

 

DESCRIPTION OF SERVICE

 

Oath on Three is an accountability enforcement service. We are not coaches, therapists, financial advisors, medical professionals, or legal advisors. We do not provide coaching, mentoring, counseling, therapy, financial advice, legal advice, or medical guidance of any kind.

 

You, the client (“Client,” “you,” or “your”), declare a single measurable commitment (“Oath”) for a 30-day cycle. We enforce that Oath through daily check-ins, escalation procedures, and pre-authorized financial consequences for non-compliance.

 

The Service is voluntary. You choose your own commitment, set your own consequence, and enroll of your own free will.

 

ELIGIBILITY

 

To use this Service, you must:

(a) Be at least 18 years of age.

(b) Be a legal resident of the United States or a jurisdiction where this type of voluntary accountability arrangement is permitted.

(c) Have the legal authority to authorize financial transactions on the payment method you provide.

(d) Submit a completed application and be accepted by Oath on Three.

 

We reserve the right to decline any application for any reason.

 

ENROLLMENT AND COMMITMENT

 

Application. You must submit an application through our website. Acceptance is at our sole discretion. Not all applicants are accepted.

 

The Oath. Upon acceptance, you will declare one specific, measurable commitment for a 30-day cycle. Your Oath cannot be changed, modified, or renegotiated during an active cycle. You may declare a new or modified Oath at the start of your next 30-day cycle.

 

Minimum Term. The Service requires a minimum enrollment of three (1) 30-day cycle. By enrolling, you agree to the full minimum term.

 

Renewal. After the minimum term, your enrollment continues on a month-to-month basis until cancelled by either party with at least seven (7) days written notice before the next cycle begins.

 

FEES AND PAYMENT

 

1, Monthly Fee. The current monthly fee for the Service is displayed on our website at the time of enrollment. Fees are billed monthly in advance at the start of each 30-day cycle.

2. Payment Authorization. By enrolling, you authorize us to charge your selected payment method for the monthly fee on a recurring basis for the duration of your enrollment.

3. No Refunds. There are no refunds for any reason, including early cancellation, dissatisfaction, or failure to use the Service. Enforcement only works if the financial commitment is real. By enrolling, you acknowledge and accept this policy.

4. Late or Failed Payments. If a payment fails, we will attempt to process it again within 48 hours. If payment cannot be collected, your enrollment may be suspended or terminated at our discretion.

PRE-AUTHORIZED CONSEQUENCE

1. Voluntary Consequence. As part of enrollment, you will pre-authorize a financial consequence — a donation to a pre-approved nonprofit organization from our list whose mission you personally oppose.

2. Your Selection. You select the consequence amount and the recipient organization. By making this selection, you certify that:

(a) You have no financial, employment, board, familial, or other material relationship with the selected organization.

(b) You genuinely oppose the mission of the selected organization.

(c) You understand that this consequence is designed to be uncomfortable and that discomfort is the mechanism through which the Service operates.

3. Triggering the Consequence. Your consequence is triggered when you fail to meet the terms of your Oath as determined by the enforcement protocol established during onboarding. The specific number of missed days or failures that triggers the consequence will be agreed upon during your onboarding process.

 

4. Execution. When triggered, the pre-authorized donation is processed automatically. Oath on Three does not receive or handle consequence funds. We administer the pre-authorization that you set up.

5. No Appeals. Once a consequence is triggered, there are no appeals, reversals, or do-overs. This is the core of the Service and the reason it works.

6. Exceptions. We maintain a documented exception process for genuine emergencies (medical, family, or legal emergencies). “I got busy,” “I forgot,” or “I was traveling” are not emergencies. Exception requests are reviewed at our sole discretion.

DAILY ENFORCEMENT

1. Check-Ins. We will contact you daily via text message to confirm whether you completed your declared commitment for that day. You are required to respond truthfully by the daily deadline established during onboarding.

2. Escalation. If you do not respond by the daily deadline, we may escalate through additional text messages and/or phone calls. You consent to receiving these communications as part of the Service.

3. Honesty. The Service operates on trust. You are expected to respond truthfully to all check-ins. If we determine that you are being dishonest about your compliance, we reserve the right to terminate your enrollment without refund.

COMMUNICATIONS CONSENT

By enrolling, you expressly consent to receive daily text messages, phone calls, and emails from Oath on Three related to the enforcement of your Oath. These communications are a core part of the Service and cannot be opted out of while enrolled. Standard messaging and data rates may apply.

 

LIMITATION OF LIABILITY

 

1. No Guarantees. We do not guarantee any specific outcome, result, or behavioral change. The Service provides enforcement infrastructure; your results depend on your own actions.

2. Assumption of Risk. You acknowledge that this Service involves voluntary financial consequences that may cause financial loss and emotional discomfort. You assume full responsibility for these risks.

3. Limitation. To the maximum extent permitted by applicable law, Oath on Three, its owner, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

(a) Your use of or inability to use the Service;

(b) Any consequence triggered under the terms of this agreement;

(c) Any unauthorized access to or alteration of your data;

(d) Any other matter relating to the Service.

4. Maximum Liability. Our total aggregate liability for any claims arising from the Service shall not exceed the total fees you have paid to Oath on Three in the three (3) months preceding the claim.

INDEMNIFICATION

 

You agree to indemnify, defend, and hold harmless Oath on Three, its owner, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

(a) Your use of the Service;

(b) Your violation of these Terms;

(c) Your violation of any rights of any third party;

(d) Any dispute between you and the recipient organization of your consequence donation.

 

INTELLECTUAL PROPERTY

 

All content on the Oath on Three website, including text, graphics, logos, and design, is the property of Oath on Three and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

 

TERMINATION

 

1. By You. You may cancel your enrollment by providing written notice at least seven (7) days before the start of your next 30-day cycle. Cancellation during the minimum term does not entitle you to a refund of fees already paid.

 

2. By Us. We reserve the right to terminate your enrollment at any time, with or without cause, including but not limited to dishonesty during check-ins, abusive behavior toward our staff, attempts to game the system, or failure to pay fees. Termination by us does not entitle you to a refund.

DISPUTE RESOLUTION

1. Governing Law. These Terms are governed by the laws of the State of Texas without regard to its conflict of laws provisions.

2. Informal Resolution. Before filing any formal dispute, you agree to first contact us at [your email] to attempt to resolve the matter informally within thirty (30) days.

3. Arbitration. Any dispute not resolved informally shall be resolved by binding arbitration in the State of Texas in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

MODIFICATIONS

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or posted on our website. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

 

SEVERABILITY

 

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

 

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oath on Three regarding the Service.
